The Custody Battle Continues For Jesse James
Jesse James spent a third day at Orange County's Family Court today at a hearing that will decide if James will get full custody of his 6-year-old daughter, Sunny.
James, who is moving at the end of the month to a house he bought in Austin, Texas, (just 17 miles away from Sandra Bullock's) plans to take Sunny with him, if the courts allow it.
According to James, his ex -- Janine Lindemulder, "has yet to hit rock bottom and [he] fears when she does it will involve Sunny."

Jesse told the court today, "[Sunny's] thriving, doing well in school, she has an amazing relationship with her brother and sister and Sandy," adding," We're getting to a point where we can live in peace....[Moving] will only make things better."
James says that since his ex was released from a halfway house for violation probation earlier this month Sunny has changed. She "acts out, she's more agitated, she has sleeping problems. The more contact she has with her mom, the more fear she has to sleep in her own room."
Lindemulder says that James is in violation of their 50/50 split custody rights, saying she has only seen Sunny eight out of a possible fifteen scheduled visits since she was released from the halfway house. Lindemulder also says she feels like she's being replaced by Sandra Bullock.
On Monday, two of Sunny's teachers testified that Sandra has made derogatory comments about Lindemulder.
One teacher testified that Bullock told her "Quite frankly, I'm glad Janine is in jail. She can go ruin someone else's life."
"Both Miss Bullock and Mr. James made derogatory comments," said Alex Bon of Carden Academy in Huntington Beach. "Sunny looked in shock."
Bon said that she was told not to send any of the Sunny's artwork to Lindemulder, who was reportedly "very loving towards Sunny," while she was in jail.
James also acknowledged that Lindemulder has had four clean drug tests recently, and that their daughter loves her mom very much.
It may be in Sunny's best interest to make the move with her dad, she reportedly "misses" Sandra and her baby brother, Louis. Plus, the move to Texas will definitely get the family out of the spotlight. At this point it's all about healing wounds between Sandra and Jesse as well as giving safe and proper care to the children.

There was also a discussion in the courtroom about Lindemulder following James to Texas to be closer to their daughter, and though she'd be with without friends, family or a job, Lindemulder says she is considering it.
The courts will be making their final decision on Friday whether Sunny is going with James or not.
