It’s been confirmed: TomCruise and Katie Holmes are getting a divorce after five years of marriage!

“This is a personal andprivate matter for Katie and her family,” Jonathan Wolfe, Katie’s attorney,told PEOPLE. “Katie’s primary concern remains, as it always has been, herdaughter’s best interest.”

Tom and Katie wed backin in 2006 in an extravagant ceremony in an Italian castle and have onedaughter, Suri, 6. This is Katie’s first marriage, but Tom’s third. Stay tuned for moreupdates!

UPDATE: Katie was the one who filed for the divorce, according to TMZ. In the divorce documents, filed on June 28, she cited "irreconcilable differences" and is seeking sole legal custody and "primary residential custody" of Suri. Tom was "blind-sided" and definitely wasn't expecting this. 

-- Tom's rep released a statement, saying, "Kate has filed for divorce and Tom is deeply saddenedand is concentrating on his three children.  Please allow them theirprivacy to work this out."

-- Sources tell TMZ that Katie is seeking sole custody due to Tom's Scientology religion. Since Suri is at the age where the beliefs could play a significant role in her life, Kate is seeking custody "specifically because she does not want Tom to control decisions relating to religion."
