Katie Holmes better watch out because it doesn't appear as though Tom Cruise is going to quietly sign over his parenting rights to Suri Cruise. Tom's lawyer, Bert Fields, issued a statement about Tom's pending divorce, revealing that Tom may seek joint custody of Suri. Tom's lawyer also called Katie and her legal team out on playing "the media."

The statement read, "Tactically we can't say where Tom will file a divorce case if he'll be seeking joint custody of Suri. We are letting 'the other side' (Katie and her team), play the media until they wear everyone out and then we'll have something to say. It's not Tom's style to do this publicly. He is really sad about what's happening," the BBC reports.

Although, Tom's team claims Katie's team is "playing the media," her lawyer says it isn't so. Jonathan Wolfe, Katie's lawyer, issued a statement that read, "The reports about an emergent filing last Friday are incorrect. Other than her action for divorce, the only pending application filed by Ms. Holmes remains her request for an anonymous caption," the LA Times Blog reports.

At least they agree on one thing.... keeping the divorce proceedings private. It's a start..... Right?

What do you think, should Tom get joint custody of Suri?
