Halle Berry's family woes just went from bad to worse. Way, way worse.

Earlier this month, a judge denied the actress permission to move to France with her four-year-old daughter Nahla. Now she plans to seek a permanent restraining order against her baby daddy Gabriel Aubry after he initiated a fight with her fiance Oliver Martinez. On Thanksgiving. With Nahla watching! Gabriel was arrested and an emergency restraining order forbid him to come within 100 yards of the trio. However, he's out on bail and that ban is lifted tomorrow, so Halle wants to make it permanent, according to Daily Mail.

Even though the official title says the restraining order would be permanent, Halle would have the power to lift it at any time. "If Gabriel can't control himself enough to protect Nahla from emotional trauma, it's too risky for him to be around the child, Halle or her fiance," said a source. It's unclear if Halle will have to continue paying child support to Gabriel while his ban is in place, but that could be some major leverage for her in their bitter child custody case.

And the big question: who won the fight? While Olivier suffered an injury to his hand, Gabriel had a broken rib and bruises on his face. Both went to the emergency room. We might have to call this one a draw.
