Grey’s Anatomy star Eric Dane, made headlines yesterday when his XXX tape, featuring himself, his wife Rebecca Gayheart, and madam Kari Ann Peniche, spread like wildfire on the Internet.
Dane’s Lawyer, Marty Singer, is furious with the media and the public that they are calling this scandalous tape a “sex tape” when there apparently was no sex involved, just nudity.
“This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public,” said Singer.
The statement continues: “Although the participants are nude, the tape is not a ’sex tape.’ It is a private tape made for only my clients’ personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients’ rights and will be exposed to significant liability.”
In the “nude tape,” the threesome appear to be high on something and they discuss their “porn names” and later the tape ends with Rebecca and Kari Ann in the tub naked talking gibberish about rubber ducks. Really not that interesting.
Here is a strange twist to the story: The non-sex tape was in Kari Ann’s possession not Eric or Rebecca, the footage was taken at Kari Ann’s apartment, and she has a theory on who leaked it.

Kari Ann tells TMZ the video featuring the whacked-out naked trio was shot more than two years ago in her apartment. Kari Ann insists there was absolutely no sex involved — they played dress up and the two women then soaked together in a bathtub as Eric called “action” behind the camera.
Kari Ann says the video was stored on the hard drive of her computer, but stolen by Mindy McCready, who was her roommate after the two completed a stint on the TV show “Celebrity Rehab.” Kari Ann says she got into an argument with McCready over money and believes the singer took her hard drive when she moved out. Kari Ann freaked out about certain personal information about her on the hard drive and filed a stolen property report with the LAPD.
Last month there was a summit between Eric, Rebecca, Kari Ann and Mindy. Their reps hammered out a deal as to who got what on the hard drive. Eric got full rights to the video and everyone assumed that was that … until the tape surfaced on the Internet today.
So a little song, a little dance a little betrayal down your pants.
